What is India Data Protection Law?
In 2018, the Srikrishna committee published a draft bill for a new, comprehensive data protection law, the personal data protection bill 2018 in response to a mandate the Indian government received from the Indian Supreme Court the previous year, following its ruling that recognised privacy as a fundamental right.
The Bill is heavily influenced by the EU’s general data protection regulation, the new bill would grant Indian data subjects extensive data protection rights while imposing limitations on the collection and processing of personal and sensitive data.
Why is India Data Protection Law Important?
The bill would apply to government as well as private organizations whether they are data collectors or data processors that collect, store, disclose, share or otherwise use personal data connected to any business carried out in India or as a result of offering of goods and services to data subjects/principals in India, or profiling of data principals within India.
